PRAYER: Petition filed under Section 115 of C.P.C., to call for the records relating to the order dated 19.11.2020 passed in EA No.19 of 2019 in Unfiled EP No.NIL/2009 in OS No.377/1997 on the file of District Munsif Cum Judicial Magistrate Court, Needamangalam and set aside the same and direct the Learned District Munsif, Needamangalam.

ORDER

Pending the civil revision petition, the parties have arrived at an amicable compromise, the terms of which are reduced to writing by way of a Joint Memorandum of Compromise. The said Joint Memorandum of Compromise dated 28.11.2025 has been filed by the petitioners 2 to 4 & 6 to 8 and the respondents 1 to 4. The remaining two petitioners are no more.

2. The said Joint Memorandum of Compromise dated 28.11.2025 has been duly signed by the parties as well as by their respective counsel.

3. In view of the above and as agreed by the parties, the respondents 1 to 4 shall execute a sale deed in favour of the petitioners 2 to 4 and 6 to 8 for a sum of Rs.12,00,000/- (Rupees Twelve Lakhs only) in full and final settlement,

on or before 30.01.2026 by way of three separate demand drafts drawn in favour of the respondents 2, 3 and 4.

4. The 3rd petitioner and 4th respondent are present before this Court and they have also affirmed the terms of compromise, on behalf of themselves and on behalf of the other petitioners and the other respondents respectively. The parties are also provided for a default clause in the Joint Memorandum of Compromise. Therefore, nothing remains to be adjudicated and the said Joint Memorandum of Compromise dated 28.11.2025 is recorded.

5. Accordingly, this Civil Revision Petition is disposed of in terms of the Joint Memorandum of Compromise dated 28.11.2025. The Joint Memorandum of Compromise dated 28.11.2025 shall form part and parcel of this order. No costs.
