This petition has been filed to withdraw the H.M.O.P No.5871 of 2022 which is pending on the file of the IV Additional Family Court, Chennai and transfer the same to the Family Court, Ramanathapuram. 1/4
2. Heard the learned counsel for the petitioner and there is no representation on the behalf of the respondent.
3. It is seen from the records, the respondent filed HMOP No.5871 of 2022, on the file of IV Additional Family Court, Chennai, for divorce. The petitioner is a resident of Ramanathapuram District and aged about 57 years and suffering from low back ache sciatica and the distance between Chennai and Ramanathapuram is nearly about 500 kilometers.
4. The reason assigned by the petitioner is justifiable. Hence, this Court is inclined to transfer HMOP No.5871 of 2022, pending on the file of the IV Additional Family Court, Chennai, to the Family Court, Ramanathapuram.
5. Accordingly, the present Tr.C.M.P. is allowed and HMOP No.5871 of 2022, pending on the file of the IV Additional Family Court, Chennai, is withdrawn and transferred to the file of the Family Court, Ramanathapuram. Further, the concerned Court is directed to transfer the records in connection with H.M.O.P No.5871 of 2022, within a period of four weeks from the date of 2/4
receipt of a copy of this order. No costs. Consequently connected miscellaneous petition is closed.
