This Court, by an earlier order dated 09.01.2023, had disposed of the writ petition and directed the 3rd respondent to open the seal of the godown for the purpose of removing 80 bags of Turmeric and 180 bags of Dry Chillies of the petitioner.

2.Today when the matter was called, I am informed that the above direction has been complied with and the petitioner has also removed the bags from the godown. Insofar as that aspect is concerned, the relief sought by the petitioner in the writ petition had been granted. 3.Now, the learned counsel for the petitioner wants to expand the scope of the writ petition by stating that the sealing of the godown once again is not proper.

4.It is seen that consequent to the registration of the First Information Report, a Final Report under Section 173 of Cr.P.C had been presented by the Investigation Officer before the Judicial Magistrate No.IV, Coimbatore and the records have also been submitted. The petitioner herein incidentally is the 2nd accused.

5.Naturally, summons would be issued to the petitioner. He will have to take necessary steps before the Judicial Magistrate No.IV, Coimbatore, in manner known to law. It for the Judicial Magistrate No.IV, to examine the materials available and thereafter take a considered decision. The writ Court cannot either give an indication or even enter into the discussion about that particular aspect, since substantial relief had been granted to the petitioner.
