PRAYER: : Transfer Civil Miscellaneous Petition filed under 24 of Code of Civil Procedure, pleased to withdraw and transfer the case in H.M.O.P.No.62 of 2024 pending on the file of the Subordinate Court, Ambur to the file of the Subordinate Court, Ambattur in the interest of justice. ORDER

Seeking to transfer H.M.O.P.No.62 of 2024 pending on the file of the Subordinate Court, Ambur, to the file of the Subordinate Court, Ambattur, the petitioner wife has preferred the above Transfer Civil Miscellaneous Petition. 1/4

2.The reasons for the transfer has set out and argued on behalf of the petitioner as follows:- a)the petitioner and her three year old daughter are residing at Ambattur, Chennai. The petitioner and the respondent has last resided at Ambattur, Chennai and she has filed a petition for divorce in H.M.O.P.No.42 of 2025. Respondent husband has filed a petition for restitution of conjugal rights in H.M.O.P.No.62 of 2024.

b)The petitioner wife has also filed a Domestic Violence Case in D.V.C.No.72 of 2024 before the learned Judicial Magistrate, Ambattur. c)The petitioner would submit that she finds it extremely difficult to travel to Ambur to attend the hearings of H.M.O.P.No.62 of 2024. She is also not financially in a sound position.

3.Heard the learned counsels on either side and perused the records. 4.Considering the above circumstances, the request for transfer is reasonable and justified. Hence, Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.62 of 2024 pending on the file of the Subordinate Court, Ambur, 2/4

is withdrawn and transferred to the file of the Subordinate Court, Ambattur. 5.Accordingly, the Transfer Civil Miscellaneous Petition is allowed. No costs.
