JUDGMENT

Challenging the decree and judgement dated 23.11.1987 passed in A.S.No.165 of 1984 by the learned Subordinate Judge, Villupuram, confirming the decree and judgement dated 10.10.1984 passed in O.S.No.920 of 1982 by the District Munsif,Tirukoilur, declaring the title of the suit property in favour of the plaintiff and granting injunction against the defendants from trespassing into the suit property, the defendants 1 and 3 in the original suit are before this court with this second appeal.

2. This second appeal was earlier listed before this court on 18.02.2019 for admission. On that day, there was no representation for the appellant. However, with a view to afford an opportunity to the appellant, this matter was ordered to be listed on 20.02.2019. On 20.02.2019 also, there was no representation for the appellant and as such, the matter was ordered to be listed today under the caption "For Dismissal". Even today, there is no representation for the appellant. It appears that appellant is not interested in prosecuting the matter further. Hence, this second appeal is dismissed for non prosecution. No costs. Consequently, connected CMP is closed.
