ORDER

This petition has been filed to direct the first respondent to register a case on the petitioner's complaint dated 17.05.2016.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. 3.

It is represented by the learned Additional Public Prosecutor that on the complaint given by the petitioner, petition enquiry in CSR No.197 of 2016 is pending. Similarly, on the counter complaint given by the opposite party against this petitioner, enquiry in CSR No.198 of 2016 is pending. It is further submitted that the petitioner is not cooperating in the enquiry.

In view of the above submission of the learned Additional Public Prosecutor, the petitioner is directed to appear before the first respondent police and co-operate in the enquiry and the respondent police shall enquire into both the complaints. It is made clear that during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the petitioner and the opposite party. This Criminal Original Petition is disposed of with the above direction.
