ORDER

This Civil Miscellaneous Petition has been filed seeking to bring on record the petitioners herein as respondents 3 to 4 in SA SR No.128115 of 2023 being legal representatives of deceased 1 st respondent.

2. Mr.K.Balasubramanian, learned counsel for appellants submitted that pending appeal, the 1 st respondent passed away on 30.07.2024 issueless behind no direct class-I legal heirs. He would submit that being son and daughter, 1 st respondent/blood brother viz., Srinivasan and the deceased had left a registered Will under document No. 14/2024 in favour of appellant and another Will under Doc. No.17/2024 in favour of Mrs.Y.Suvitha to succeed her estate. Hence, it is just and necessary to implead them as legal representatives of deceased 1 st respondent. Accordingly, he filed this petition.

3. Considering the facts and circumstances and being satisfied with the reasons assigned in the affidavit, this petition is allowed. The proposed legal representatives of the 1 st respondent are impleaded as respondents 3 to 4 in the above Second Appeal. The Registry is directed to carry out the necessary amendment in the cause title.
