ORDER
The present writ petition is filed challenging the orders passed by the second respondent herein vide proceedings in Na.Ka.No.1529/Uu/2022, dated 05.01.2023, confirming the order passed by the third respondent vide proceedings in Na.Ka.No.3901/Aa4/2021, dated 04.03.2022.
2. Learned counsel for the petitioner would submit that the impugned order 2/5
has been made invoking Section 68(2) of the Registration Act, 1908 and thus cannot be sustained, which was agreed to by the learned Special Government Pleader for respondents 1 to 4.
3. After submitting for a brief while, learned counsel for respondents 5 and 6 would submit that they may be at liberty to avail of remedy available in the manner known to law.
4. In view thereof, the impugned order dated 05.01.2023 is set aside. Liberty, as prayer for by the learned counsel for the respondents 5 and 6, is granted.
5. Accordingly, the writ petition stands disposed of. There will be no order as to costs.
