ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c), 20(b)(ii)(A) of NDPS Act, 1985 & 328 of IPC in Crime No. 389 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found to be in illegal possession of 500 grams of ganja. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case, and submitted that the petitioner is involved in the possession, transportation, and sale of ganja. He further submitted that there are 2 previous cases pending against the petitioner herein. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Considering the nature of the offence committed by the petitioner, and it is alleged that the petitioner supplied 500 grams of ganja and taking note of the fact that there are 2 previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
