ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 6(4),TN Scheduled Commodities (RDCS) order (1982) and Section 4(1)(a) (ii) Essential Commodities Act (1955) in Crime No.349 of 2025 on the file of the respondent police seeks anticipatory bail. 1/4

2. The case of the prosecution is that on 31.12.2025 the respondent received the information that some unknown persons were attempting to sell the PDS rice in the black market. Thereafter, the respondent police went to the scene of occurrence and found that the petitioner along with two other accused have attempted to transport 2500 kgs of PDS rice in the black market. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. However, the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner joined hands with other accused and attempted to sell 2500 kgs of PDS rice in the black market. He further submitted that there are 3 previous cases pending against the petitioner and on enquiry it is found that the petitioner/A1 has engaged A2 and A3 to collect the PDS rice for the purpose 2/4

of selling it in the black market. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record including the FIR.

6. Considering the submissions made by both sides; the nature of offence; the quantity involved in this case is very huge and the bad antecedents of the petitioner, this Court is not not inclined to grant anticipatory bail to the petitioner.
