ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2) & 326(a) of BNS, 2023, in Crime No.355 of 2024, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner was found in Page No.1 of 4

illegal possession of 1 1⁄2 unit of river sand in Vehicle Reg. No.TN 69 BC 7246. Hence the case.

3.The learned counsel for the petitioner would submit that this is third anticipatory bail Application. The earlier anticipatory bail applications were dismissed as withdrawn; that the petitioner is innocent; that he has been falsely implicated in this case and since custodial interrogation of the petitioner is not required for the purpose of investigation, he sought for grant of anticipatory bail.

4.Per contra, the learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner has five previous cases.

5. Considering the fact that this is the third bail application and the earlier bail applications were dismissed, taking into account the gravity of offence and the petitioner has bad antecedence, this Court is not inclined to grant anticipatory bail to the petitioner.
