The plaintiff filed this application to grant leave to sue against the 1 st and nd defendants.

2.According to the plaintiff, the suit schedule property is situated within the jurisdiction of the Court and the 1 st and 2 nd defendants are residing outside the jurisdiction of the Court. The plaintiff filed the main suit for the relief of partition and separate possession. Therefore, she filed this application.

3. This Court perused the records and the substantial part of the cause of action arose within the jurisdiction of this Court and the suit schedule property is also situated within the jurisdiction of this Court and the 1 st and 2 nd defendants are residing outside the jurisdiction of this Court. Therefore, considering the nature of the suit and considering the reasons stated in the affidavit and the facts and circumstances of the case, this application is allowed. Leave is granted.
