Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of declaration, declaring Regulation 23 of Customs Brokers Licensing Regulations, 2013, as notified under Notification No.65/2013-Cus. (N.T), dated 21.6.2013 as ultra vires of Section 146 of Customs Act, 1962.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The writ petition has been filed, inter alia, challenging the provisions of the Customs Brokers Licensing Regulations, 2013.

2. The writ petitioner does not wish to pursue the challenge to the Regulations. The petitioner, therefore, prays for withdrawal of the writ petition.

3. The writ petition is dismissed as withdrawn. The dismissal of the writ petition will not prevent the petitioner from filing a fresh writ petition challenging the order of prohibition of Customs Broker Licence. No costs. Consequently, W.M.P.No.10797 of 2017 is closed.
