Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 10.10.2015 and order may be passed for the payment of medical reimbursement amount of Rs.1,00,000/- or eligible amount.

By consent, this Writ Petition is taken up for final disposal.

2.The petitioner retired from service as High School Headmaster on 31.10.2004 and drawing pension, vide Pension Payment Order No.C177332/EDJ and he is also a subscriber of the Tamil Nadu Pensioners Health Fund Scheme and a sum of Rs.75/- per month is deducted from his pension towards the said scheme. The petitioner would further aver that on 31.07.2015, he was admitted in Vijaya Hospital, Chennai due to "Herpes Zoster Seconday Infection Sepsis, Type 2 Diabetes Mellitus Surgery" and incurred medical expenses of Rs.1,00,000/- and got discharged on 09.08.2015. The petitioner sent a representation to the respondent during August 2015 to reimburse the medical expenditure as per G.O.Ms.No.458 (Pension) Department dated 21.09.2007, followed by another representation dated 10.10.2015 https://hcservices.ecourts.gov.in/hcservices/

and inspite of receipt and acknowledgment, no response was forthcoming and hence, came forward with this Writ Petition.

3. Heard the submissions of the learned counsel appearing for the petitioner and Mr.P.Chinnadurai, learned Government Advocate, who accepts notice on behalf of the respondent.

4. Though the petitioner prays for larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the same, directs the second respondent to consider and dispose of the petitioner's representation dated 10.10.2015 and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
