Respondent Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to call for the records in Crl.M.P.No.1178 of 2024 in Crl.M.P.No.28502 of 2023 in C.A.No.664 of 2023 on the file of the Principal Sessions Judge at Chennai, setaside the order dated 11.01.2024 passed by the Principal Sessions Judge at Chennai in Crl.M.P.No.1178 of 2024 in Crl.M.P.No.28502 of 2023 in C.A.No.664 of 2023 and extend time to deposit of 20 percent of the compensation as per the orders of the Honble Principal Sessions Judge dated 07.11.2023 passed in Crl.M.P.No.28202/2023 in C.A.No.664 of 2023 and pass such further orders as this Honble Court may deem fit and proper and thus render justice.

ORDER

This Criminal Original Petition has been filed challenging the order passed by the Court below dated 11.01.2024, canceling the suspension of sentence granted in favour of the petitioner on the ground that the petitioner did not comply with one of the condition that has been imposed by directing the petitioner to deposit 20% of the compensation amount.

2. Heard Mr.A.Prabhakara Reddy for APR Associates, learned counsel for the petitioner and carefully perused the materials available on record.

3. Taking into consideration the facts and circumstances of the case and the reasons assigned by the learned counsel for the petitioner, the time granted to the petitioner is extended for a period of three weeks from today to deposit the 20% of the compensation amount. It is made clear that no 2\4

further extension of time will be granted. If the petitioner deposits the amount within the time extended by this Court, the earlier order passed by the Court below in Crl MP No.28502 of 2023 dated 07.11.2023 will be revived. If the petitioner fails to deposit the amount within the time stipulated by this Court, the cancellation order dated 11.01.2024 shall stand revived and in which event, the petitioner will be secured and made to undergo the sentence imposed by the Trial Court.

4. This Criminal Original petition is disposed of in the above terms.
