The prayer sought for herein is for a writ mandamus directing the first respondent herein to cancel the sale agreement in Document No.6001 of 2022 dated 05.08.2022 before the Purasavakkam SubRegistrar, Ayanavaram, Chennai in the name of Purchaser J.Shahulhameed within the stipulated period as fixed by this Court.
2. In order to cancel the sale agreement entered into between the petitioner and the second respondent, the petitioner has given a representation to the first respondent on 06.01.2023 and in order to consider the same, the petitioner has moved the present writ petition.
3. Heard Mr.R.Sathyamurthi, learned counsel appearing for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the first respondent.
4. In view of the order going to be passed in this writ petition, notice to the second respondent is hereby dispensed with.
5. Learned Special Government Pleader appearing for the first 2/4
respondent would submit that the representation given by the petitioner dated 06.01.2023 would be considered and decided on merits of-course after giving notice to both the petitioner as well as the second respondent within a time frame that may be stipulated by this Court.
6. Considering the said submission made by the learned Special Government Pleader appearing for the first respondent, this Court directs the first respondent to issue notice to both the petitioner and the second respondent and after hearing them, the needful action may be taken on the representation submitted by the petitioner dated 06.01.2023 within a period of six(6) weeks from the date of receipt of a copy of this order.
