This miscellaneous petition has been filed to condone the delay of 1323 days in filing the above civil miscellaneous appeal against the judgment and decree dated 27.02.2019 made in MACT.OP.No.4370 of 2015 on the file of the Principal Special Judge, Special Court under EC and NDPS Act, (Motor Accidents Claims Tribunal as per G.O.(MS) No.716, Home (tr.IV) Dept dated 07.06.2016, Chennai.

2. Though notice was served on the sole respondent and the name of the sole respondent printed in the cause list, none appears.

3. I have gone through the affidavit filed in support of the petition and I am of the view that this petition may be allowed subject to the condition that the petitioner will not be entitled to interest for the period of delay of 1323 days.

4. With the above said condition, this miscellaneous petition is allowed and the delay of 1323 days is condoned. 1/4
