Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to select and appoint the petitioner to the post of BT Assistant (Mathematics) based on the orders of the second respondent in Na.Ka.No.3285/Aa2/2008 dated 27.12.2008 and as per the directions passed by the High Court of Madras in W.P.No.808 of 2010 dated 10.08.2010 and subsequent orders passed by the State Government in G.O.Ms.No.133 School Education Department dated 04.06.2012 declaring, equivalence of B.Sc., Statistics (University of Madras) with B.Sc., Mathematics by representation made by the Petitioner dated 25.06.2012 with all consequential and attendant benefits including seniority and merits in selection, within a time frame to be fixed by this Court. O R D E R

The relief sought for in this writ petition is for a direction to the respondents to select and appoint the writ petitioner to the post of BT Assistant (Mathematics).

2.This Court cannot consider such a direction for the issuance of the appointment order to the writ petitioner. However, the learned counsel appearing for the writ petitioner submits that already the benefits of equivalence sought for by the writ petitioner have been extended by the Government by passing G.O.Ms.No.133, School Education Department, dated 04.06.2012. Thus, it is for the respondents to consider the equivalence granted by the Government in respect of the facts of the case and accordingly take a decision in this regard. The writ petitioner also submitted a representation on 25.06.2012 to the respondents.

3.Without going into the merits of the case, the first respondent is directed to consider the representation submitted by the writ petitioner on 25.06.2012 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 4.Accordingly, the Writ Petition stands disposed of. However, there is no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
