Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to measure and fix boundaries stones at land in S.Nos.299/7,9,10 & 11 at No.6, Pallavada Village, Gummidipoondi Taluk, Thiruvallur District by passing orders on the representation dated 16.02.2022.

O R D E R

This Writ Petition has been filed seeking for issuance of a Writ of Mandamus, to direct the respondents to measure and fix boundary stones in the lands in S.Nos.299/7,9,10 & 11 at No.6,

Pallavada Village, Gummidipoondi Taluk, Thiruvallur District by passing orders on the representation dated 16.02.2022.

2. The case of the petitioner is that she is the owner of the aforesaid property and she has obtained Patta No.347-1431 and Chitta is also in her favour and she is in the possession and enjoyment of the same without any interference. The petitioner has made a oral representation before the 4th respondent and she has also paid the necessary charges to measure her land. The 4th respondent issued a letter dated 24.01.2022, stating that the land will be measured on 09.02.2022 as per the Chitta. However, on the said date, the 4th respondent did not visit and measure the land. Thereafter, the petitioner has made a representation dated 16.02.2022 to the respondents 1 to 3, seeking to measure the property by fixing boundary stones as per the Chitta and Patta. As the said representation made by the petitioner has evoked no response from the respondents, the petitioner has filed this present Writ Petition.

3. The learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 16.02.2022 and pass orders on the same within a particular time frame that may be fixed by this Court.

4. Mr.G.Nanmaran, the learned Special Government Pleader for the respondents submitted that, if any direction is given by this Court, the same will be complied with.

5. In view of the aforesaid submissions, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 16.02.2022 and pass appropriate orders, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
