The Civil Revision Petition has been filed against the Fair and decreetal order in I.A.No.733/11 in I.A.No.311/10 in O.S.No.140/04 dated 30.10.12 on the file of the III Additional District and Sessions Judge, Salemi

2. When the matter is taken up for hearing today, the learned counsel appearing for the respondent submitted that the suit itself has been dismissed for default. Hence, the present Revision Petition has become infructuous.

3. Recording the above submissions, this Civil Revision Petition is dismissed as infructuous. In the event of restoring the suit, the revision petitioner is at liberty to file an application to restore this petition. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
