Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the first respondent herein to include the name of petitioner herein in the ensuing panel for promotion to the post of Forest Ranger for the year 2011-2012 not withstanding and without reference to the disciplinary proceedings initiated against the Petitioner in Pro.Ka.No.8763/2010/P1 dated 05.07.2011 by the second Respondent, if he is otherwise qualified and to promote him as such, with all consequential benefits. ORDER

The writ petition has been filed to direct the first respondent herein to include the name of petitioner herein in the ensuing panel for promotion to the post of Forest Ranger for the year 2011-2012 not withstanding and without reference to the disciplinary proceedings initiated against the Petitioner.

It is seen that the disciplinary proceeding was initiated as against the petitioner and the same was challenged by him in W.P.No.16090 of 2015 and the same was pending before this Court. Now the petitioner died and the legal representatives of the deceased

petitioner were substituted as petitioners in the present writ petition. Further the relief sought for in this writ petition can be considered subject to the result of the another writ petition in W.P.No.16090 of 2015. Therefore, the prayer sought for in this writ petition cannot be considered.

Accordingly, the Writ Petition stands dismissed.

Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
