Respondent Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 16.08.2022 and consequently direct the respondent to upload the Chitta in Survey No.657/2 to the extent of 0.79.0 and Survey No.659/1 to the extent of 0.37.0 Hectare situated at Nakondapalli Village, Hosur Taluk, Krishnagiri District in the official website of the Tamil Nadu State Government.

The prayer sought for herein is for a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 16.08.2022 and 1 / 4

consequently direct the respondent to upload the Chitta in Survey No.657/2 to the extent of 0.79.0 and Survey No.659/1 to the extent of 0.37.0 Hectare situated at Nakondapalli Village, Hosur Taluk, Krishnagiri District in the official website of the Tamil Nadu State Government.

In respect of the property situated in Survey No.657/2 to the extent of 0.79.0 and Survey No.659/1 to the extent of 0.37.0 Hectare situated at Nakondapalli Village, Hosur Taluk, Krishnagiri District, the patta was issued in the name of the petitioner's father. Therefore, the petitioner wanted to have patta in his name and the names of other legal heirs and he has made a representation to that effect on 16.08.2022 to the respondent District Collector and in order consider the same, the present writ petition has been filed.

3. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.

Learned Special Government Pleader submits that, issuance of patta is the job of the Tahsildar concerned to whom no representation / application has been made by the petitioner and it is only given to the District Collector who has been arrayed as a party respondent in this writ petition. Therefore, if the petitioner comes forward to make an application to the Tahsildar concerned in 2 / 4

the manner of law it would be considered by the concerned Tahsildar on merits and in accordance with law.

5. Considering the submission made by the learned Special Government Pleader, this Court is inclined to dispose of this writ petition with the following order.

●It is open to the petitioner to make an application / representation to the concerned Tahsildar viz., Tahsildar, Hosur Taluk for the redressal of his grievance as projected in the representation dated 16.08.2022.

●On receipt of the same, the Tahsilar Hosur Taluk, Krishnagiri District shall consider the said application and decide the same on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. ●Since the concerned Tahsildar, viz., Tahsildar, Hosur Taluk, Krishnagiri District is not a party to this writ petition, Registry is directed to mark a copy of this order to the said authority for necessary action.
