ORDER
The petitioner, who apprehends arrest for the alleged offence under Sections 191(2), 304(2), 324(2) of BNS Act in Crime No.30 of 2026 on the file of the respondent police seeks anticipatory bail. 2.The case of the prosecution is that the petitioners herein joined hands with other accused and demolished the house and compound wall of the defacto complainant. Hence, the complaint.
3.The learned counsel appearing for the petitioners submitted that the place where the house was constructed is a common pathway and the defacto complainant has put up the construction in that area. Hence they have raised objection to put up the construction. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and produced the copy of the proceedings issued by the concerned BDO wherein, it was stated that the subject area is a private land and it belongs to a private party and the petitioners herein have demolished the construction put up in that area. Hence he opposed for grant of anticipatory bail to the petitioners.
5. Heard both sides and perused the materials available on record.
6. Considering the submissions made by both sides and the fact that the place where the construction was put up was a private land and the petitioners knowing well about the same has demolished the construction and caused loss to the defacto complainant , I am not inclined to grant anticipatory bail to the petitioners.
7. Accordingly, this Criminal Original Petition is dismissed. 09.02.2026 smn To
