PRAYER: This criminal miscellaneous petition has been filed under Section 528 of BNSS Act, to modify the condition imposed in para no. 4 of Crl.O.P.No.24717 of 2024 dated 19.10.2024 in connection with Crime No.231 of 2024 on the file of the respondent police. For Petitioner(s):

ORDER

The petitioner seeks modification of the condition to appear and sign before the Judicial Magistrate No.III, Coimbatore on every first working day of the English Calender Month at 5.00 p.m., for a period of three months.

2. The learned counsel for the petitioner would submit that the petitioner had complied with the condition for the first two months and could not comply with the condition during the third month since he was arrested in some other case.

3. The learned Government Advocate (Crl.Side) for the respondent police confirmed the aforesaid facts.

4. In view of the same, the petitioner shall appear before the learned Judicial Magistrate, No.III, Coimbatore, on 18.03.2025 @ 05.00 p.m. The other conditions imposed in the order dated 16.08.2024 in Page No.2 of 4

Crl.M.P.NO.25250 of 2024 shall remain unaltered.

5. Accordingly, the criminal miscellaneous petition is ordered and the condition is modified.
