ORDER

(Made by the Hon'ble Acting Chief Justice) The petitioner has come forward with this writ petition praying for a Writ of Mandamus directing the respondents 1 and 2 to remove the encroachment in pathway/cart track bearing S.No.1011/1 situated in Kavundapadi Village, Bhavani Taluk, Erode District.

2. It is the case of the petitioner that the third respondent has encroached into the common pathway used by the villagers in S.No.1011/3, Kavundapadi village, Bhavani Taluk, Erode District, by planting some crops. In support of his contention, the petitioner has also enclosed photographs in the typed set of papers.

3. Mr.Muthukumar, learned State Government Pleader submitted that the petitioner himself is an encroacher and all the encroachments would be removed within a period of six weeks from the date of receipt of a copy of this order.

4. In fine, the respondents 1 and 2 are directed to clear all the encroachments and maintain the cart track in a proper manner. The writ petition is disposed of with the above direction, there will be no order as to costs. (T.R., ACJ.)
