ORDER

The present application has been filed to direct the petitioner to grant Interim custody of the minor male child, named Kriyan Raj Shekar born on 08.12.2021 and currently aged about 3 years till pendency of this O.P.

2. The learned counsel appearing for the applicant would submit that the passport of the minor child had expired and she had taken out the present application to appoint her as guardian based upon the Memorandum of Understanding that had been arrived at between the parties, which permitted the applicant to have permanent custody of the child.

3. In such view of the matter, the applicant/mother is entitled to file necessary application for renewing the passport of the child, and if such an application is made by the applicant, being the mother of the child, the authorities are directed to consider the same in accordance with law and to pass appropriate orders without insisting upon the consent of the respondent/father.

4. Since it is an admitted case that the applicant/mother is in custody of the minor child, this application need not be adjudicated upon.

5. Accordingly, the application in A.No.2109 of 2025 in O.P.No.198 of 2025 stands rejected. However, there shall be no order as to costs. 30-04-2025 (1/2) kak To
