PRAYER: Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 to 4 to give protection to the petitioner and his family members his peaceful possession and enjoyment of the property in Survey No.607/1, 607/2 an extent of 4.93 acres, situated in Kodiyur Village, Pennagaram Taluk, Dharmapuri based on the petitioner's representation dated 02/02/2021 and fixed time frame.

O R D E R

This writ petition has been filed for the issue of writ of mandamus directing the respondent police to give police protection to the petitioner on the ground that the 5th and 6th respondents are illegally preventing the petitioner from enjoying the subject property.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents 1 to 4.

3.Taking into consideration the facts and circumstances of the case and also nature of the grievance expressed by the petitioner, it is clear that there is a civil dispute between the petitioner and the private respondents. The police cannot interfere with such dispute and the parties will have to agitate only before the competent civil court. Liberty is granted to the petitioner to workout his remedy before the competent civil Court. No further orders can be passed in this writ petition.
