ORDER
This writ petition has been filed to forbear the respondents from encroaching upon or constructing any building on the petitioner's patta land, measuring 100 sq.ft. in the property, morefully disclosed in the prayer to this writ petition.
2.According to the petitioner, the second respondent has encroached an extent of 100 sq.ft. into the petitioner's property, morefully disclosed in the prayer to this writ petition. Under those circumstances, the petitioner has filed this writ petition seeking to forbear the respondents from encroaching upon or constructing any building on the petitioner's patta land, measuring 100 sq.ft. in the property, morefully disclosed in the prayer to this writ petition. Prior to the filing of this writ petition, the petitioner had issued a legal notice dated 23.12.2025 to the respondents requesting them not to encroach upon the petitioner's land measuring 100 sq.ft. In the petitioner's property. 3.Admittedly, no reply was sent to the same by the respondents. 4.Mr.N.Naveen Kumar, learned Government Advocate accepts notice on behalf of respondents 1 to 5. He would submit on instructions that the respondents never encroached upon the petitioner's land as claimed in this writ
petition. He would submit that earlier there was an un-used well, which was demolished and now a ration shop is being constructed in the said property. 5.No prejudice would be caused to the respondents if the petitioner is directed to give a fresh representation to the respondents seeking for the very same relief as prayed for in this writ petition and a direction is issued to the competent authority i.e. the second respondent to pass final orders on the said representation, on merits and in accordance with law, within a time frame to be fixed by this Court.
6.This Court is not expressing any opinion on the merits of the respective contentions.
7.For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit a fresh representation to the second respondent requesting the second respondent not to encroach upon or constructing any building in the petitioner's patta land, measuring 100 sq.ft. in Survey No.77/3C, Burgur Taluk, Krishnagiri District, within a period of 2 weeks from the date of receipt of a copy of this order. On receipt of the said representation within the stipulated time, the second respondent shall pass final orders, on merits and in
accordance with law on the said representation, within a period of four weeks thereafter. Consequently, connected WMP is closed. No costs. 06-03-2026 vga
