This application has been filed seeking permission to the plaintiff to produce additional documents.

2.The plaintiff and the defendant had entered into a MoU for purchase of land and building for the purposes of running hospital. The agreement stood frustrated owing to various reasons and the suit had therefore been filed, seeking damages by the plaintiff against the defendant. 3.In paragraph No.11 of the plaint, the plaintiff had stated about the fact that the defendant had collected the completion certificate issued by the CMDA with respect to the building, which was the subject matter of the MoU. Those documents are now sought to be produced as further documents.

smv 4.The said documents namely, the completion certificate dated 23.09.2010, the letters issued by the plaintiff to the defendant dated 02.07.2021 and 10.09.2020 are permitted to be taken on record, as also the permission to the witness to tender evidence, however all documents subject to admissibility, relevancy and proof.

5.The document No.4 filed along with Judges Summons is not permitted as it is a WhatsApp communication and a perusal of the same does not reveal the telephone number of the persons, who had exchanged the WhatsApp communications.
