The Criminal Revision filed under Section 397 read with 401 of Code of Criminal Procedure call for the records relating to the judgment made in C.C.126 of 2013 dated 14.08.2013 on the file of the learned Judicial Magistrate, Perambalur and set aside the same and consequently convict the second respondent herein and punish him with maximum punishment. The defacto complainant has preferred the Criminal Revision against the order of acquittal passed by the learned Judicial Magistrate , Perambalur in C.C.No.126 of 2013, dated 14.08.2013.

2. The petitioner/defacto complainant preferred a complaint against the 2nd respondent for offence punishable under Sections 454 and 380 IPC. The learned trial Judge, after full fledged trial, acquitted the accused by a well reasoned order. As against the same, the petitioner has come forward with this petition.

3. As against the judgment of acquittal, appeal lies before the Sessions Court as per amended Act. Therefore, this Revision does not lie before this Court, accordingly it is disposed of. However, if the petitioner wants to file an appeal before the Sessions Court, he can file. The period spent for this revision is exempted for the purpose of limitation.
