ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 379 of I.P.C r/w. Section 21

(1) of Mines and Minerals (Development & Regulation) Act 1957 in Crime No.140 of 2019 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that when the respondent police were on regular patrol, they found that the petitioner had illegally transported 3 units of river sand in a tipper lorry bearing Regn.No.TN-34-J-3058 without proper license.

3. The learned counsel for the petitioner has submitted that the petitioner has not committed any such offences as alleged by the prosecution and he has been falsely implicated in this case. Hence, he pleads for anticipatory bail.

4. The learned Government Advocate (Crl.Side) raised an objection for granting anticipatory bail to the petitioner stating that the petitioner is the owner of the vehicle alleged to have illegally transported 3 units of river sand.

5. Considering the nature of offence committed by the petitioner ie., exploitation of natural resources, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. -sd/- 02/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
