PRAYER:

Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 and 2 to dispose the petitioner's Appeal dated 02.09.2025 given under Maintenance and Welfare of Parents and Senior Citizens Act, 2007 within stipulated time as deemed fit by this Hon'ble Court.

ORDER

In view of the nature of the relief that is prayed and the order that is passed, the writ petition is disposed of, at the admission stage itself, without notice to the other private respondents.

2. This Court is not expressing any opinion on the sustainability of the claim of the petitioner or otherwise. The prayer made in the writ petition is that the petitioner has filed an appeal on 02.09.2025 before the first respondent, aggrieved by the quantum of maintenance awarded by the second respondent and the same is pending.

3.The learned Special Government Pleader would submit that if adequate time is granted, the appeal will be disposed of.

4.In view thereof, the Writ Petition is disposed of on the following terms:- (i)The first respondent is requested to take up the appeal dated 02.09.2025 and dispose of the same, as expeditiously as possible, in any event, not later than 4 months from the date of receipt of a web copy of this order, without waiting for the certified copy of this order. (ii)It is needless to mention that the notice shall be issued to the petitioner as well as the private respondents or any other person interested and the issue shall be decided.

(iii)Consequently, connected Miscellaneous Petition is closed.
