Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To condone the absence on 03.02.2020 and relax the condition made in Crl.M.P.No.1/2011 in Crl.A.No.621/2010 order date on 11.04.2011.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.SHANKER, Advocate for the petitioner, and of MR.K.SRIVIVASAN, Special Public Prosecutor for CBI-cases, on behalf of the Respondent, the court made the following order:- The above petition is filed seeking to condone the petitioner's absence on 03.02.2020 and to relax the condition made in Crl.MP.No.1 of 2011 in Crl.A.No. 621 of 2010 dated 11.04.2011. 2.The learned counsel for the petitioner would submit that this Court, in an earlier occasion, has granted bail to the petitioner by imposing on condition that the petitioner shall deposit a sum of Rs.1,00,000/- vide order dated 12.02.2020 in Crl.MP.No.796 of 2020 in Crl.RC.No.120 of 2020, but the petitioner had furnished the sureties only on 13.02.

2020 and the petitioner was absented himself only one hearing. He would further submit that the petitioner is the only bread winner of his family and he has to take care of his aged father and his family, hence he prays for condone of one hearing absence. 3.The Special Government Pleader appearing for CBCID cases, conceded the request made by the learned counsel for the petitioner . https://hcservices.ecourts.gov.

4.Heard both sides.

5. Being satisfied with the reasons stated the affidavit filed in support of this petition, the absence of the petitioner for one hearing on 03.02.2020, is condoned. However, the petitioner is directed to strictly comply with the conditions imposed in Crl.MP.No.1 of 2011 in Crl.A.621 of 2010 dated 11.04.2011 and further, default, if any, will be viewed seriously. 6.The Criminal Miscellaneous Petition is ordered accordingly. -sd/- 24/02/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
