PRAYER: Criminal Miscellaneous Petition is filed under Section 528 BNSS Act, 2023, to modify the condition, directing the petitioner to deposit 40 percentage of the compensation amount, imposed in order dated 27.01.2026 in Crl.M.P.No. 894 of 2026 in Crl.RC.No.147 of 2026 on the file of this Court. ORDER

This petitioner has been filed seeking to modify the condition directing the petitioner to deposit 40% of the compensation amount imposed in the order dated 27.01.2026 in Crl.M.P.No. 894 of 2026 in Crl.RC.No.147 of 2026 on the file of this Court.

2. Heard the learned counsel for the petitioner.

3. Admittedly, the petitioner has not complied with the conditional order dated 27.01.2026. The petitioner has expressed difficulty in making deposit of 40% of the cheque amount. Considering the request, the said condition is modified and the petitioner is directed to deposit 30% of the cheque amount within four weeks from today, failing which, the order granting suspension of sentence shall stand vacated without further reference to this Court.

4. All other conditions remain unaltered.

5. This Criminal Miscellaneous petition is ordered, accordingly. Page No.2/4
