Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus calling for the records connected with the orders passed by the 2nd respondent in Proc.No.66853/TL8/TNSTC/2009, dated 23.05.2010, quash the same and also direct the respondent to refix the petitioner's pay to the original scale and also to repay the amount already deducted from his wages. This Writ Petition is filed challenging the impugned order, dated 23.05.2010, in and by which, in the appeal filed by the petitioner, the punishment was modified on compassionate basis and was imposed with the punishment of reduction to the lowest stage of pay.

2. Even though the Writ Petition is filed in the year 2011, pending the Writ Petition, the further Review Petition filed by the petitioner was considered and by order, dated 06.01.2012, the punishment was further modified as postponement of increment for a period of 12 months with cumulative effect. The said order was also given effect to and thereafter, the petitioner also superannuated from service with effect from 29.01.2016.

3. In that view of the matter, nothing remains to be adjudicated in this Writ Petition. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 30.11.2023 Index : yes Speaking order : no grs 2/4
