ORDER

This writ petition has been filed to direct the second respondent to return the sale certificate, presented by the petitioner for registration, after registering

the same and also refund the excess fees remitted by the petitioner, based on the demand of the second respondent, based on the petitioner's representation dated 13.11.2025, within a time frame to be fixed by this Court. 2.The petitioner claims that since the sale certificate was issued by the authorised officer of the bank as per the provisions of the SARFAESI Act, the said certificate ought to have been registered by the second respondent and returned to the petitioner. The petitioner also seeks for refund of excess fees, remitted by the petitioner for the said sale certificate, based on the demand made by the second respondent. According to him, the excess collection from the petitioner is arbitrary and illegal. The petitioner had given a representation on 13.11.2025 to the second respondent for the aforesaid purpose. Since the same was not considered, the petitioner has filed this writ petition. 3.Mr.U.Baranidharan, learned Special Government Pleader accepts notice on behalf of the respondents.

4.No prejudice would be caused to the respondents if the petitioner's representation, as stated supra, is considered, on merits and in accordance with law within a time frame to be fixed by this Court.

5.This Court is not expressing any opinion on the merits of the petitioner's representation.

6.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 13.11.2025 seeking for return of the sale certificate dated 10.12.2024, after registration and for refund of the alleged excess fees paid by the petitioner, based on the demand made by the second respondent, within a period of four weeks from the date of receipt of a copy of this order. No costs.
