This Criminal Original Petition filed under Section 482 Cr.P.C. praying that the case in Crime No.369 of 2011 on the file of the 2nd respondent may be transferred to the file of the Deputy Superintendent of Police, CBCID, Chennai, the 3rd respondent herein or any other agency that this Court directs to conduct fair and impartial investigation of the case. ORDER

This Criminal Original Petition has been filed seeking for transfer of investigation in Crime No.369 of 2011 on the file of the 2nd respondent.

2.It is seen that the 2nd respondent had conducted an enquiry and completed the investigation in Crime No.369 of 2011 and also filed the Referred Charge Sheet before the concerned Jurisdictional Magistrate.

3.Considering the facts and circumstance, the prayer sought for by the petitioner cannot be considered by this Court. However, the 2nd respondent is directed to serve the R.C.S notice to the petitioner. On receipt of the same, the petitioner is at liberty to file a Protest Petition before the concerned Jurisdictional Magistrate.

4.With the above said direction, this Criminal Original Petition is disposed of.
