Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records of the 2nd respondent in Memorandum No.57/PJN/E1/2012-13 dated 06.09.2012 and to quash the same as being illegal and unsustainable, and direct the respondents to treat the leave availed by the petitioner on 01.06.2012, 26.06.2012, 27.06.2012 and 18.07.2012 as special casual leave. For Petitioner : M/s.N.Kavitha For Respondents : Ms.Sharada Vivek Additional Government Pleader (P) for R1 Mr.Mani Sundar Gopal for R2 COMMON ORDER All these batch of Writ Petitions arise out of two departmental proceedings initiated against the petitioner by the respondent Institute. In some of the Writ Petitions, the petitioner has challenged the order of suspension, and in others, the initiation of disciplinary proceedings against the petitioner has been challenged.
2. Today, when the matter is taken up for consideration, it is brought to the notice of this Court by the learned counsel on either side that the petitioner
was already reinstated into service by revoking the suspension as early as on 24.10.2018, with effect from 02.11.2018, and the petitioner has been continuing in service.
3. In view of the same, the Writ Petitions filed challenging the order of suspension have become infructuous.
4. Insofar as the two disciplinary proceedings that were initiated and are pending against the petitioner are concerned, the respondents have already passed an order bearing No.8284/CS(Agri)/A7/2020 Government of Puducherry, Chief Secretariat (Agriculture) dated 28.04.2022, closing both the departmental proceedings with a warning. The petitioner was already served with the said order as early as in the year 2022. However, the petitioner has not taken any steps against the said order, dated 28.04.2022.

By the said order, it was also decided that the sealed cover in respect of the Career Advancement Scheme of the petitioner would be opened, and he would be given upgradation as per the assessment contained in the sealed cover. However, as submitted by the learned counsel for the petitioner, the said process of opening the sealed cover and considering the petitioner's case
for upgradation has not taken place in view of the pendency of these Writ Petitions.

In light of the order dated 28.04.2022 already passed by the respondents, the respondents are directed to complete the process of opening the sealed cover and consider the petitioner's claim for upgradation under the Career Advancement Scheme as expeditiously as possible, at any rate, within a period of six weeks from the date of receipt of a copy of this order.

Insofar as the request made by the learned counsel for the petitioner to treat the period of suspension as a period spent on leave is concerned, the petitioner is granted liberty to submit a representation before the respondents. In case such a representation is made, the respondents shall consider the same, in accordance with law, within a period of eight (8) weeks from the date of submission of such representation by the petitioner.
8. In the light of the above, this Court is convinced that the reliefs sought in all these Writ Petitions have become infructuous. Accordingly, all these Writ Petitions are closed as having become infructuous, subject to the directions at Paragraph Nos.6 and 7 above. No costs. Consequently,
