2. The petitioner would submit that her father was employed as an Electrical Mestri in the Public Works Department. Her father initially married the 5th respondent, Anandhi, and subsequently married the petitioner's mother, S. Rathna. The petitioner's mother passed away on

20.03.2009 and thereafter, the petitioner and her brother were brought up in the family house by the fifth respondent. The petitioner's father died while in service on 08.03.2024, leaving behind the petitioner, her brother and respondents 5 to 8 as his legal heirs.

3. The petitioner would further submit that, after the death of her father, the 5th respondent received the terminal benefits payable to the deceased employee. According to the petitioner, she and her brother were denied an equitable share in the benefits and were subsequently compelled to leave the family residence. Being unemployed and dependent on others for sustenance, the petitioner requested the 5th respondent to share half of family pension amount of Rs.37,000/-. However, the 5th respondent refused to comply. Hence, the petitioner submitted a representation dated 24.12.2024 to the 4th respondent seeking half of the family pension under Section 49 (7)(a)(i)(b) of The Tamil Nadu Pension Rules, 1978. However, no response has been received to date. Hence, the petitioner is before this Court.

4. Heard the learned counsel appearing on either side and perused the materials available on record.

5. Considering the relief sought for by the petitioner, this Court, without going into the merits of the case, directs the 4th respondent to consider the petitioner's representation dated 24.12.2024, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.

6. Accordingly, the writ petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 05-06-2026 Index: Yes/No Speaking/Non-speaking order SRN
