ORDER
This Writ Petition has been filed challenging the impugned notice, dated 19.01.2026 issued by the 2nd respondent.
2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 and 2. Since no adverse order has been passed against the 3rd respondent in this writ petition, notice to the 3rd respondent is dispensed with by this Court.
3. The petitioner has challenged the impugned notice on the ground that the said notice has been issued arbitrarily and illegally by total non-application of mind to the fact that the 2nd respondent had already decided the issue in respect of the impugned notice as early as in the year 2012 and 2025 by relegating the parties to approach the Civil Court. The relevant orders passed by the 2nd respondent has also been placed on record by the learned counsel for the petitioner before this Court.

The learned Special Government Pleader appearing for the respondents 1 and 2 has also placed on record the instructions received by him, more particularly, he has placed on record the communication received by the 2nd respondent from the Commissioner of Land Administration, dated 07.10.2025. As seen from the said communication, since the parties have already been relegated to go before the Civil Court pursuant to the directions issued by the very same 2nd respondent through the earlier orders, the Commissioner of Land Administration has directed the 2nd respondent not to hold an enquiry with regard to the representation given by the 3rd respondent, which is the subject matter of this writ petition as well as the subject matter of the impugned notice. Therefore, the learned Special Government Pleader appearing for the respondents 1 and 2 would submit that the question of acting upon the impugned notice issued by the 2nd respondent does not arise. The said submission made by the learned Special Government Pleader appearing for the respondents 1 and 2 on instructions is recorded.

The learned counsel for the petitioner is also satisfied that if the same is recorded, this writ petition can be disposed of after recording the letter dated 07.10.2025 sent by the Commissioner of Land Administration to the 2nd respondent, which has been placed on record by the learned Special Government Pleader appearing for the respondents 1 and 2. A copy of the same has also been served on the learned counsel for the petitioner in the open court and served on the 3rd respondent as well by registered post with acknowledgement due.

In view of the same, the impugned notice, dated 19.01.2026 issued by the 2nd respondent cannot be acted by the 2nd respondent and it is made clear that the 2nd respondent shall not issue any further notice to the petitioner as well as the 3rd respondent in respect of the very same representation given by the 3rd respondent, since the parties have been directed to approach the Civil Court with regard to the dispute raised by the 3rd respondent through her representation.
