Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent to consider and pass orders on the petitioner's representation dated 07.12.2018 with regard to payment of Rs.8,39,127/- (Rupees Eight Lakhs Thirty Nine Thousand One Hundred and Twenty Seven Only) for completion of contract electrical work in various places in Pallipattu Taluk, Tiruvellore District, given by the 2nd respondent. Mr.R.Govindasamy, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the 2nd respondent to consider and pass orders on the petitioner's representation dated 07.12.2018 with regard to payment of Rs.8,39,127/- (Rupees Eight Lakhs Thirty Nine Thousand One Hundred and Twenty Seven Only) for completion of contract electrical work in various places in Pallipattu Taluk, Tiruvellore District.

The grievance of the petitioner before this Court is that even after completion of the electrical works to the satisfaction of the authorities as a registered contractor, the second respondent is not disbursing the amount payable towards such completion of the works. It is also stated that the petitioner approached the first respondent and made a request for payment, who in turn, through his proceedings dated 27.12.2018 directed the second respondent to consider the claim of the petitioner and pass appropriate orders. Therefore, it is stated that the second respondent is not justified in keeping the matter pending.

This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the second respondent to consider and decide the same, based on the representation made by the petitioner on 07.12.2018. Thus, this writ petition is disposed of, only with a direction to the second respondent to consider the representation dated 07.12.2018 and pass orders on the same on merits and in accordance with law. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
