ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS 2023 r/w Section 21(1) of Mines and Minerals (Development and Regulation )Act 1957, in Crime No.303 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. This Court has dismissed the earlier anticipatory bail petition of the petitioner in Crl.O.P.No.445 of 2026 on 12.01.2026 for the following reasons:

6. Considering the nature of offence committed by these petitioners and if these petitioners are granted anticipatory bail, they will involve in similar activities and since there is no change in circumstances, this Court is not inclined to grant anticipatory bail to these petitioners.

3. It is seen from records that this is the third anticipatory bail petition and this Court has twice dismissed the anticipatory bail petition of the petitioner.

4. In view of the above facts and this is the third anticipatory bail petition, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. This Court directs the petitioner to surrender before the concerned police station and thereafter file an appropriate petition before this Court. 17.02.2026 smn 2/4
