ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.01.2026 for the alleged offence punishable under Sections 296(b), 115(2), 118(1), 109(1), 351(3) of BNS, 2023 in Crime No.2 of 2026, registered on the file of the respondent police, seeks bail.

2. The allegation of the petitioner is that they went to the shop of the defacto complainant and after eating food developed a quarrel, during which they attacked the defacto complainant and others. It is further alleged that they poured hot oil to one of the victims, causing burn injuries, and also assaulted another person with iron rod. Hence, a case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioners submitted that the petitioners are A2 and A3 and that there is a counter case registered against the defacto complainant in Crime No.1 of 2026 and that the petitioners are ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that in the occurrence, two persons sustained injuries, one suffered grievous injuries and the other sustained burn injuries due to hot oil and that the investigation is still pending. Hence, he opposed to grant bail to the petitioner.

5. Considering the fact that the petitioners herein joined together and caused grievous injuries to two persons who were running a hotel, and that the occurrence too in a busy public area, this Court is not inclined to grant bail to the petitioner.
