Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Crl.A.No.552/2017 on the file of the High Court, the High Court will be pleased to suspend the sentence and enlarge the petitioner/appellant on bail in C.C.No.7 of 2002 judgment dated 12.07.2017 made by the learned XI Additional Special Judge for CBI Cases (Relating to Banks and Financial Institutions) at Chennai pending disposal of the Criminal Appeal on the file of the Hon'ble Court. Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.552/2017 on the file of the High Court and upon hearing the arguments of M/S.A.MADHUMATHI, Advocate for the petitioner, the court made the following order:- Seeking to suspend the sentence imposed on the petitioner by the learned XI Additional Special Judge for CBI cases (Relating to Banks and Financial Institutions) at Chennai dated 12.07.2017, in C.C.No.7 of 2002 and enlarge the petitioner on bail pending disposal of criminal appeal, the petitioner is before this Court with this petition.
2. Heard the learned counsel for the petitioner and the learned Special Public Prosecutor (CBI cases) appearing for the respondent.
3. It is submitted by the learned Special Public Prosecutor (CBI cases) that the fine amount has already been paid by the petitioner and considering the grounds of appeal and also the fact that the co-accused have also been granted suspension of sentence in similar case, I am inclined to allow this miscellaneous petition and the order passed by the XI Additional Special Judge for CBI cases (Relating to Banks and Financial Institutions) at Chennai 12.07.2017, in C.C.No.7 of 2002 is suspended on condition that the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties each for a like sum to the satisfaction of the XI Additional Special Judge for CBI cases (Relating to Banks and Financial Institutions) at Chennai . Further, the petitioner shall appear before the trial Court on every first working day of every month at 10.30 a.m until further orders. -sd/- 04/09/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
