ORDER

The petitioners, apprehends arrest at the hands of the respondent police for the offence punishable under Sections 8(c), 22(c), 23, 27A, 28, 29 & 9 A read with Section 25A of the NDPS Act, 1985 in CC.No.48 of 2017, on the file of learned II Additional Court Special Judge for EC and NDPS Cases at Chennai.

2. When the matter was taken up for hearing, the learned Special Public prosecutor, appearing for the respondent submitted that this Court had earlier granted bail to the petitioners vide order dated 25.06.2018 in Crl.R.C.No.1575 of 2017. The said order was challenged before the Hon'ble Apex Court in Criminal Appeal No.363 of 2022. The Hon'ble Apex Court set aside the order passed by this Court and directed the petitioners to surrender before the Trial Court within a period of two weeks, granting liberty to them to file a fresh application for bail before the Trial Court. The Trial Court was also directed to consider such application on its own merits and it accordance with law.

3. Considering the above submissions, this Court is of the view that the present anticipatory bail petition filed by the petitioners is not maintainable.

4. Accordingly, this Criminal Original Petition stands dismissed. The petitioners are directed to comply with the directions issued by the Hon'ble Apex Court vide order dated 07.03.2022, in Criminal Appeal No.363 of 2022. 19-02-2026 Index: Yes/No Speaking/Non-speaking order JAI
