ORDER
This transfer civil miscellaneous petition has been filed seeking to withdraw the HOMP.No.386 of 2024 from the file of Subordinate Court,
Poonamallee and transfer the same to the file of Family Court, Nagapattinam.
2. Heard the learned counsel for the parties.
3. The transfer civil miscellaneous petition has been filed by the wife who is the respondent in HMOP.No.386 of 2024 on the file of the Subordinate Court, Poonamallee. Though the petitioner has prayed for transfer of proceedings on the file of Family Court, Nagapattinam and has requested by way of amendment application supported by an affidavit of the petitioner seeking transfer to Subordinate Court, Nagapattinam instead of the Family Court, Nagapattinam, the learned counsel for the respondent fairly submitted that the respondenthusband has no serious objection for transfer request being acceded to as prayed for by the petitioner.
4. In view of the above, HMOP.No.386 of 2024 is withdrawn from the file of Subordinate Court, Poonamallee and transferred to the file of Subordinate Court, Nagapattinam. It is made clear that the physical presence of the
respondent-husband shall not be insisted upon by the Subordinate Court, Nagapattinam for all hearing dates, except where it is absolutely necessary. Accordingly, the transfer civil miscellaneous petition is allowed. No costs.
