JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) The present intra Court appeal has been instituted to assail the writ order dated 16.11.2021 passed in W.P.No.24340 of 2021. The writ petitioner/ Flat Owners Welfare Association is the appellant. The Writ Petition has been instituted challenging the demand notice issued by the Assistant Executive Engineer, TANGEDCO, vide demand letter dated 03.09.2018.

2. Learned counsel for the appellant would contend that the tariff applied in respect of the members of the Flat Owners Association is not in consonance to the tariff which is applicable. If so, the Association or the aggrieved members of the flat owners or occupants may approach the Consumer Grievance Redressal Forum constituted under Clause 18 of the Electricity Supply Code for effective adjudication of disputed facts.

3. No writ against such demand notice is entertainable and all such disputed facts involved are to be adjudicated before the competent authority

and in the present case, Consumer Grievance Redressal Forum has been constitution under the Supply Code and thus, the appellant has to exhaust the remedy contemplated under the Act. Granting liberty to the appellant to approach the Consumer Grievance Redressal Forum, the present Writ Appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
