The petitioners who apprehend arrest at the hands of the respondent Police for the offences punishable under Section 406 and 420 of IPC in Crime No.96 of 2023, seek anticipatory bail.
2. The case of prosecution is that the petitioners herein are the close relatives of A1 and they obtained hand loan for sum of Rs.7 lakhs from the defacto complainant with a false promise to repay the said amount within three months, subsequently failed to repay it. When the same was questioned, they abused with filthy language and also cheated the defacto complainant. Hence, the complaint.
3. The learned counsel appearing for the petitioners submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) submits that the petitioners herein are the close relatives of A1 and they obtained hand loan for sum of Rs.7 lakhs from the defacto complainant with a false promise to repay the said amount within three months and failed to repay it. He further submits that when the same was questioned by him, they abused with filthy language and also cheated the defacto complainant. Hence, he opposed for grant of anticipatory bail to the petitioners.
5. Considering the facts and circumstances of the case, gravity of the offence, and the investigation is at initial stage, possibility of abscondance and detail investigation in this case is required, this Court is not inclined to grant the relief sought for in this petition.
6. Accordingly, this Criminal Original Petition for anticipatory bail stands dismissed.
