M. Harihara Sivan Shankar v. C.Subash Chandra Bose

2025-03-05Honourable Ms. Justice P.T. Asha1 pages

CRP.No.885 of 2026 P.B.BALAJI, J.

The learned counsel appearing for the parties fairly submit that, as against the dismissal of the Interlocutory Application in I.A. No.5 of 2024, an appeal in C.M.A. No.120 of 2026 is pending before this Court.

The present Civil Revision Petition challenges the order passed in I.A. No.6 of 2024, which is an application seeking condonation of delay of 197 days in filing the petition to set aside the ex parte decree. In such view of the matter, it is just and proper that both the Civil Revision Petition and the appeal are heard together to avoid any conflicting orders and multiplicity of proceedings.

2. The Registry is directed to place the papers before the Hon'ble The Chief Justice for obtaining appropriate orders for tagging this Civil Revision Petition along with C.M.A. No.120 of 2026 and for listing the matters together.
