Prayer:Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to place the Complaint dated 04.01.2019 of the petitioner, along with the other complaints made by the other persons/ jamathars made against the 3rd respondent, before the Tamil Nadu Wakf Board meeting for enquiry, within the stipulated time. The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the first respondent to place the complaint dated 04.01.2019 of the petitioner, along with the other complaints made by the other persons/ jamathars
against the third respondent, before the Tamil Nadu Wakf Board meeting for enquiry, within the stipulated time. 2.When the matter was taken up for consideration, the learned counsel appearing for the third respondent submitted that the relief sought for by the petitioner has been complied with and the complaints were placed before Tamil Nadu Wakf Board and in turn the Tamil Nadu Wakf Board referred the matter to the Vigilance and Anti Corruption Department to take action against the third respondent.
3.The learned counsel appearing for the respondents 1 and 2 submitted that pursuant to the complaint made by the petitioner, a criminal case was registered as against the third respondent and subsequently disciplinary proceedings was initiated against the third respondent and after conducting enquiry, the disciplinary proceedings was closed. 4.Since the complaints were placed before Tamil Nadu Wakf Board and in turn the Tamil Nadu Wakf Board referred the matter to the Vigilance and Anti Corruption Department to take action against the third respondent, the relief sought for by the petitioner has been complied with. Further, pursuant to the complaint made by the petitioner, a criminal case was registered as against the third respondent and subsequently disciplinary proceedings was initiated against the third respondent and after enquiry, the same was closed. Hence, nothing survives for adjudication in this writ petition.
5.This writ petition is accordingly closed. However, liberty is granted to the petitioner to work out the remedy in the manner known to law. No costs. Consequently, the connected miscellaneous petition is closed.
